PBCs in NSW & ACT
When native title is recognised by the Federal Court, native title holders must nominate a Prescribed Body Corporate (PBC) to hold, manage and protect the native title rights and interests of all native title holders.
The PBC is the main contact for all stakeholders who want to engage with native title holders, or do something that may affect native title. Generally, native title holders will run and manage their own PBC, and every PBC must consult with native title holders and get their consent before making decisions about native title matters.
NTSCORP provides support to PBCs including:
- Advice and assistance with ongoing governance and record keeping requirements under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth), the Native Title Act 1993 (Cth), and the PBC’s Rule book;
- Legal advice negotiating and entering native title agreements on behalf of native title holders;
- General organisational support including the implementation of Agreements and assistance securing PBC Support Funding.
