Overview Of Native Title Matters In NSW and The Act In 2008-2009

New Native Title Applications

Four new native title applications were filed during 2008-2009, none of which are represented by NTSCORP.

They include three applications in North East Wiradjuri Country in and around Bathurst, Lithgow and Mudgee, primarily filed in response to future act notices for exploration and an application by Numbahjing People in and around Ballina.


Discontinued or Dismissed Native Title Applications

Six native title applications were discontinued in 2008-2009, including the two Saltwater Kattang applications and the Ngiyampaa People (Mulga Creek), Barkandji #1, Numbahjing and Ngaorigu applications.

One native title application, the Nucoorilma Gamilaaroy application, was dismissed by the Federal Court in 2008-2009.


New Non-Claimant Applications

Eleven new non-claimant applications were filed during 2008-2009:

  • Melody Sarmiento Hartog and Joanne Hartog
  • Gosford City Council
  • Gandangarra Local Aboriginal Land Council #1

  • Gandangarra Local Aboriginal Land Council #2
  • Gandangarra Local Aboriginal Land Council #3;
  • Gandangarra Local Aboriginal Land Council #4
  • Gosford City Council

Discontinued, Dismissed or Determined Non-Claimant Applications

Thirteen non-claimant applications were finalised in 2008-2009:

  • Cabonne Council
  • Peter Hillig as Administrator of Worimi Local Aboriginal Land Council
  • The Honorary Bob Debus, MP, Minister for the Environment for the State of New South Wales (Barren Grounds)
  • Sada Services Pty Ltd
  • Minister for Lands for the State of New South Wales (Glenthorne)
  • Eden Local Aboriginal Land Council
  • Darkinjung Local Aboriginal Land Council
  • Greater Hume Shire Council
  • Hector Allan Le Brocq
  • Gordon: Warwick, Maclaren and Angus
  • Anthony and Bernadette Meppem
  • Monbeef Pty Lt
  • Nambucca Heads Local Aboriginal
  • Land Council

Of those applications, three applications brought by Local Aboriginal Land Councils resulted in determinations that native title did not exist.
